DeVos under Attack

As She Attempts to return the Rule of Law To Our Education System
Prepare for the Leftist Media Attack on DeVos

A judicial process that doesn’t allow the accused to cross-examine his accuser or reliably see the evidence against him is a civil libertarian’s nightmare. It traduces every principle of fairness and is blatantly un-American.


Education Secretary Betsy DeVos intends to remedy this abomination, but will be savaged by the Left for replacing just such a process with something more in keeping with our Constitutional legal norms.

The Education Department is preparing new rules that would roll back the monstrously unfair Obama-era requirements for how colleges handle sexual-assault and harassment allegations. It will be a significant advance for due process, which is almost as out of style on campus as free speech.




In one of its least defensible actions, the Obama Administration used its Office for Civil Rights to impose its preferred procedures for handling sexual-assault cases on all the universities in the country that receive federal funds; it did so via a 19-page “Dear Colleague” letter, in the name of Title IX, the provision in federal law prohibiting sexual discrimination in education.

The Obama process was terrible, blowing right past the Administrative Procedure Act, which requires public notice and comment before such rules go into effect.


And the substance was worse.


The letter reads as if it were written by inflamed activists who had no interest in balanced proceedings – and it was.



1) It required colleges to adopt a “preponderance of evidence” standard
rather than a “clear and convincing” standard.

2) It essentially forbade colleges from allowing the cross-examination of accusers.

3) It adopted a remarkably broad definition of sexual harassment to include “unwelcome sexual advances, requests for sexual favors, and other verbal, nonverbal, or physical conduct of a sexual nature.

4) It also encouraged the use of a “single investigator-adjudicator system,”
i.e., a single person as investigator, judge and jury.


The Obama rules ignore central developments in 
Anglo-American justice that arose hundreds of years ago! 

 In their important book “The Campus Rape Frenzy” KC Johnson and Stuart Taylor Jr. describe how the rules often played out:

“Start with an alcohol-soaked set of facts that 
no state’s criminal law would consider sexual assault. 
Add an incomplete ‘investigation,’ unfair procedures, and a 
disciplinary panel uninterested in evidence of innocence. 
Stir in a “de facto” presumption of guilt based on misguided 
Obama Administration dictates, ideological zeal, and fear of bad publicity.” 

The result inevitably, has been horrific miscarriages of justice.

Everyone should want perpetrators of sexual assault to be punished — and in the criminal-justice system, not just by colleges — but elementary protections for the accused cannot be discarded in the process.





One reason the Obama rules were so lopsided is that they were crafted in an atmosphere of moral panic – assuming a spiraling epidemic of sexual assault on campus.



To the contrary, Taylor and Johnson note that sexual assaults of female college students
had dropped by more than 50% between 1997 and 2013,

-- and that young women in college are less likely to be assaulted than those who are not in college. 






The Obama rules have been battered in the courts, where due process is still taken seriously.

A US District Court judge wrote in a 2016 ruling against Brandeis University:

 “If a college student is to be marked for life as a sexual predator, 
it is reasonable to require that he be provided a fair opportunity t
o defend himself and an impartial arbiter to make that decision. 
Put simply, a fair determination of the facts requires a fair process, 
not tilted to favor a particular outcome, and a fair and neutral fact-finder, 
not predisposed to reach a particular conclusion.” 

This is the animating spirit behind the DeVos changes.

 They are still being formulated, but a New York Times report suggests that they will correct the worst excesses of the Obama rules and interject fairness into proceedings that were, shamefully, designed to lack it.

We have watched such legal abominations during the Obama years destroy the lives of college students who have been given no recourse to senseless and groundless allegations, with no rationale other than the accuser had just broken up with a boyfriend and wanted to see him suffer; or, in the case of a hooker in Durham, NC, claiming that she was assaulted by an entire LaCrosse Team --  a case elevated to and prosecuted in a local court, with the District Attorney later disbarred for concealing exculpatory evidence, to include DNA samples plus testimony by the hooker's associates who stated the hooker bragged to them that she had lied about the entire event -- she had only been hired to dance at a team victory party!

Under the Obama Administration, the Rule of Law was replaced by Political Hysteria!

Social Security: RIP?

There have been renewed reports that this Administration is closing down Social Security offices and reducing services as demand increases by an aging population.  Employee reductions of 21,000 are in the works - to be replaced by "external partners", i.e., other government agencies and contractors.

Future applicants may be subject to eligibility screening by the credit-rating firm Experian [currently under "multi-state investigation" for violating consumer protection laws.

Mr Obama has been quietly, but steadily reducing funding for the Social Security Administration -- by about $1 billion in recent years.  The secret [draft] plan, created by a specious but impressively titled entity [The National Academy of Public Administration] is outlined at this link calling for a "smaller workforce" [i.e., layoffs], and "reduced physical infrastructure" [closing field offices].  Members of this National Academy include current and former employees of:
IBM
Cisco
Grant Thornton
and career bureaucrats and the editor of Government Executive magazine.


The operative, but unintelligible phrase in the study is
"Our communication and business practices enable a dispersed workforce that is no longer working in centralized, traditional offices"

Translated:
We're closing down the field offices, replacing them with on-line connections; and you can no longer have a human to deal with, except "in very limited circumstances."

Visits to Social Security offices now include screening by aggressively arrogant guards who are heavily armed; the SSA last year purchased a billion rounds of hollow point ammunition - for what purpose we're not sure.

Perhaps they fear a frontal attack by cane-waving seniors.

Now, to be clear, Social Security is not funded by the federal government, even though it is administered by the federal government.

All funding is derived from mandatory contributions by Americans who are and have been employed throughout their adult lives.  These contributions are made as a percentage of pre-tax income; when the taxpayers eventually are eligible to receive Social Security "benefits",  they are taxed on those benefits again as "income".

Officially, Social Security "is the largest social welfare program in the United States, constituting 37% of government expenditure and 7% of GDP."

Originally, Social Security funds were separate front the US Treasury, and payments were made directly to recipients.  Traditionally, there was always a surplus, and it was expected this would always be the case.

But, under the Democratic Administration of Lyndon Johnson, Social Security revenue was transferred to Treasury's General Revenue pot and used to fund LBJ's Great Society welfare programs; subsequently, these funds have become a slush fund for every Democratic sponsored welfare program since -- leading to Congressional wailing that
"Social Security is running out of money!"
thus the need to raise taxes again.



Democrats blame the Republicans for Social Security shortcomings since the GOP works diligently to reduce welfare and the public dole.  In the meantime, the Democrats continue to generate more expensive social welfare programs to be funded by employed Americans.



Return the Social Security Administration to its status as separate from the federal government and fence in its budget to dispense benefits ONLY to eligible Social Security contributors, and this fund will return to solvency and surpluses.

But, that would mean the US could no longer support illegal aliens and the permanently unemployed Welfare Class that functions as a generational parasite on our economy.

Lower Interest Rates on Student Loans?

Senate Democrats killed GOP House Bill which tied student loan rates to the Treasury Note 10 Year Rate of 2.6%

NPR [National Public Radio] subsidized by taxpayers and oil companies, has become the propaganda organ for the Administration and the Democrats in general -- ever on the attack on anything and everything Conservative/GOP.

Today's headline tells us that those mean old Republicans have killed a bill in the Senate which would have allowed students [and their parents] to refinance their student loans to get substantially lower rates.  But, once again, NPR is acting a purveyor of Democrat propaganda since NPR omits the critical reasons WHY the GOP blocked this bill.

They omit the fact that the House Republicans passed a bill on 23 May 2014 which would tie the interest rates on student loans directly to the interest rate on a 10-year Treasury Note.  That bill was killed by Harry Reid when it arrived at the Senate.

Instead,
Liz Warren, our Native American Senator
[well, she once saw the movie The Last Mohican, thus qualifying her to claim Indian heritage since she lives in New England, as did the Mohicans until Warren's ancestors killed them all]
proposed Tax Increase legislation in which she included one provision by which students [or their parents] could refinance their education loans.

Now, if that were the sole element in the legislation, it would have flown through Congress and straight to the Oval Office for signature, even though the earlier House Republican Bill was far more effective in reducing student loan interest rates; the GOP bill tied Student Loan Rates to Treasury's Ten-Year Note Rate, currently at 2.59%.

But, buried in the Democrat legislative proposal were lots of new taxes on "The Rich".
You know, all those "One Percenters" [of whom are many NPR luminaries and and executives].

We agree that these loans should be available for refinancing at a lower rate.
What NPR omitted from their story, however, are the details of the provisions to raise "Taxes on the Rich" to compensate the federal costs of the program causing the GOP [and conscientious Democrats] to block it.  
We call that Lying By Omission -- the basis for "Grey Propaganda".
We don't need more "taxes on the rich" -- which we've noted quickly trickle down to become increased taxes on the Middle Class. Furtively mixing in long-term taxes with otherwise appealing measures of public benefit has  been a long-term propaganda gimmick by the DNC to increase taxes for everyone under the guise of targeting the very wealthy
So, think this one through -- and read the legislation, not just the emotional headlines!
Al's kiss ended his marriage
Al Gore introduced a similar "Tax on the Rich" when he was a senator; but, due to inflation, his "Rich Category" back then now encompasses a large percentage of the Middle Class -- into which well-educated students [and their parents] will find themselves -- i.e., with higher taxes and fewer deductions.
Inflation does that.  For example, in 1960, you could buy a nice, upscale suburban house for $20,000 with an income of $10,000 per year; if you earned $35,000 a year, you were considered wealthy.  By 1980, that same house would have cost $80,000, and your income would have been $30,000 a year; you'd have been considered rich if you earned $50,000 a year.  Today, you're at the bottom end of the Middle Class if you earn $50,000 a year.

[Al doesn't pay much in taxes since he routes all his income through a trust fund which funds his house, his cars, and all his expenses; the trust fund is likely structured as a non-profit, so there would be a minimal tax liability.]
Gore's AMT [Alternate Minimum Tax on "the rich"] takes away many of these Middle Class deductions
1) standard deduction,
2) personal exemptions,
3) home equity mortgage interest,
4) miscellaneous deductions such as employee business expenses, and
5) the bargain element of any incentive stock options you exercised
Now, we suggest one alternate and very effective means to offsetting the cost to the federal government for such a program, instead of increasing taxes, would be to simply cut the subsidies and grants to NPR -- or just cutting the salaries of the all the "One Percenters" in NPR [Google NPR salaries to see who makes in the mid- 6 figures, or even 7 figures.
